Amazon fights $265M tax order

Amazon is appealing to the EU's top court to have a $265M tax order thrown out.

The contested order was issued by the European Commission after it found Luxembourg to have illegally allowed Amazon to store profits tax-free.

  • The European Commission ruled in 2017 that it was illegal for Luxembourg to allow Amazon to channel profits into a holding company tax-free.
  • The ruling noted that the tax arrangement allowed Amazon to avoid tax payments on almost three-quarters of the profits from its business in the EU.
  • As part of the ruling, the commission ordered Amazon to pay €250M ($265M) in back taxes.
  • Amazon had the order thrown out after successfully appealing to a lower European tribunal in 2021.
  • The European Commission has since appealed to the Court of Justice of the European Union (CJEU), the bloc's highest court, to revive its original ruling.
